This website is operated by Riyah Apparel (“RIYAH Apparel”), 586 Zerkee Place, Courtenay, BC V9N 8J6. Throughout the site, the terms “we”, “us” and “our” refer to RIYAH Apparel. RIYAH Apparel offers this website, including all information, tools and services available from this site, to you, the user, on the condition that you accept all terms, conditions, policies and notices stated here.

By visiting our site, purchasing from us, or requesting a quote or custom order, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including the additional terms and policies referenced here or available by link. These Terms apply to all users of the site, including browsers, customers, clients, Custom Store organizers and supporters, and contributors of content.

Please read these Terms carefully before using our website. If you do not agree to all of them, you may not use the website or our services.

Any new features or tools added to the store are also subject to these Terms. You can review the most current version at any time on this page. We may update, change or replace any part of these Terms by posting changes to our website. Your continued use of the website after changes are posted means you accept them.

Our store is hosted on Shopify Inc., which provides the online e-commerce platform that lets us sell our products and services to you.

Section 1 – Online store terms

By agreeing to these Terms, you confirm that you are at least the age of majority in your province, state or region of residence, or that you have given consent for any minor dependants to use this site. Orders for youth teams must be placed by an adult organizer, parent or guardian.

You may not use our products for any illegal or unauthorized purpose, or violate any laws in your jurisdiction (including copyright and trademark laws) in using the Service. You must not transmit any worms, viruses or code of a destructive nature. A breach of these Terms will result in immediate termination of your Services.

Section 2 – General conditions

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information) may be transferred unencrypted over various networks. Credit card information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, or any content or design on the website, without our written permission.

The headings in these Terms are for convenience only and do not limit or affect them.

Section 3 – Accuracy, completeness and timeliness of information

We are not responsible if information on this site is not accurate, complete or current. Material on this site is for general information only. We may modify the contents of this site at any time but have no obligation to update any information.

Section 4 – Modifications to the Service and prices

Prices for our products are subject to change without notice. Prices on an approved custom quote are honoured for that order. We may modify or discontinue the Service, or any part of it, at any time, and are not liable to you or any third party for any modification, price change, suspension or discontinuance.

Section 5 – Products and services

Some products are available only online and may be limited in quantity. All products are subject to our Refund Policy.

We make every effort to display product colours and images accurately, but we cannot guarantee that your screen displays any colour accurately. Printed colours are a close match to proofs and photos, not an exact match.

We may limit sales of our products or services to any person, region or jurisdiction, limit quantities, change product descriptions or pricing, or discontinue any product at any time.

Section 6 – Accuracy of billing and account information

We reserve the right to refuse or cancel any order. If we change or cancel an order, we will try to notify you using the email, phone number or address provided.

You agree to provide current, complete and accurate purchase and account information, including an up-to-date mailing address, for every order, and to update it promptly so we can complete your order and contact you. RIYAH Apparel is not responsible for orders shipped to an outdated or incorrect address that you provided.

Section 7 – Optional tools

We may give you access to third-party tools that we do not monitor or control. They are provided “as is” and “as available”, without warranties of any kind, and your use of them is at your own risk. New services or features added to the website are also subject to these Terms.

Section 8 – Third-party links

Some content, products and services on our site may come from third parties, and links may lead to websites not affiliated with us. We are not responsible for their content, accuracy, products or services. Please review a third party’s policies before transacting with them.

Section 9 – Comments, feedback, artwork and other submissions

Ideas, suggestions or feedback you send us may be used by us without obligation to keep them confidential, pay for them or respond to them.

Artwork, logos, names and images you send for a custom order remain yours. By sending them, you confirm you own them or have permission to use them, and you allow RIYAH Apparel to use them to produce, proof and promote your order. We may refuse any submission that is unlawful, hateful, offensive, or infringes anyone’s copyright, trademark, privacy or other rights. You are solely responsible for the content you submit.

Section 10 – Personal information

Your submission of personal information through the store is governed by our Privacy Policy.

Section 11 – Errors, inaccuracies and omissions

Our site may occasionally contain errors in product descriptions, pricing, promotions, shipping charges, transit times or availability. We may correct errors, update information or cancel orders if any information is inaccurate, without prior notice (including after you have submitted your order). If we cancel a paid order because of our error, we refund what you paid.

Section 12 – Prohibited uses

You may not use the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform unlawful acts; (c) to violate any international, federal, provincial or state law or local bylaw; (d) to infringe our intellectual property or anyone else’s; (e) to harass, abuse, insult, harm, defame, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload viruses or malicious code; (h) to collect or track others’ personal information; (i) to spam, phish, scrape or crawl; (j) for any obscene purpose; or (k) to interfere with the security of the Service. We may end your use of the Service for any prohibited use.

Section 13 – Disclaimer of warranties; limitation of liability

We do not guarantee that our service will be uninterrupted, timely, secure or error-free. Except as expressly stated by us, the service and all products delivered through it are provided “as is” and “as available”.

To the fullest extent permitted by law, RIYAH Apparel and its owners, employees, contractors, suppliers and service providers are not liable for any indirect, incidental, special or consequential damages, including lost profits or revenue, arising from your use of the service or any product. Our total liability for any claim related to an order is limited to the amount you paid for that order. Nothing in these Terms limits any rights you have under applicable consumer protection law.

Section 14 – Indemnification

You agree to indemnify and hold harmless RIYAH Apparel and its owners, employees, contractors and suppliers from any claim or demand, including reasonable legal fees, made by a third party because of your breach of these Terms, artwork or content you supplied, or your violation of any law or the rights of a third party.

Section 15 – Severability

If any part of these Terms is found unlawful, void or unenforceable, it will be enforced to the fullest extent permitted, and the rest of these Terms remain in effect.

Section 16 – Termination

Obligations incurred before termination survive it. These Terms are effective until ended by you or us. If we believe you have failed to comply with these Terms, we may end this agreement at any time without notice, and you remain liable for all amounts due up to that date.

Section 17 – Entire agreement

Our failure to enforce any right or provision of these Terms is not a waiver of it. These Terms, together with our policies and any approved quote or Custom Store agreement, are the entire agreement between you and us and replace any earlier agreements or communications. If an approved quote conflicts with these Terms, the quote governs for that order.

Section 18 – Governing law

These Terms and any separate agreements under which we provide you Services are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there.

Section 19 – Changes to these Terms

You can review the most current version of these Terms at any time on this page. We may update, change or replace any part of them by posting changes to our website. Changes do not affect orders already approved.

Section 20 – Custom design and print orders

Quotes are valid for 10 days and are based on the garments, quantities, sizes, colours and print placements listed. Changes after approval may change the price and timeline.
Payment. Design work is paid 100% before work begins. Print orders are paid 50% when the quote is approved and the remaining 50% before the order is released.
Revisions. Design work includes 2 rounds of revisions. Additional revisions are billed at $85 per hour.
Written proof approval is required before anything is printed. You are responsible for checking spelling, names, numbers, sizes, quantities, colours and placement. Once approved, the proof is final.
Order deadline. To guarantee completion, orders must be approved, placed and paid at least 4 weeks before the event, including tournament gear. Orders needed sooner are rush orders and carry a premium price. All expedited shipping is at the client’s cost.
Added costs apply to larger sizes, personalization and multi-colour logos, as shown in the table below.
Artwork ownership. Artwork you supply stays yours. Artwork designed by RIYAH Apparel is owned by RIYAH Apparel; you may order apparel with it from us, and using it elsewhere needs our written permission.
Cancellations. Design payments are non-refundable once work has started. After proof approval, garments are ordered and print orders cannot be cancelled.

Section 21 – Custom Stores and fundraisers

Each Custom Store is open for 3 weeks. Stores open longer need a monthly subscription of $19.99 per month, which can be cancelled at any time. Clients may close their store on any date; subscription fees already collected are non-refundable, as they cover setup and overhead costs.
Base prices apply when a store reaches at least 12 orders.
All Custom Store items are made to order after the store closes. All sales are final, except as set out in our Refund Policy.
Fundraiser amounts are paid to the organizer only after the store has closed, all orders have been printed and shipped, and printing costs are covered.

Section 22 – Shipping, pickup and payment

Shipping, pickup and delivery terms are set out in our Shipping Policy. Payment methods: cards through our online store, Interac e-Transfer to payments@riyahapparel.com, or cheque payable to Riyah Apparel. Orders are not produced or released until the required payment is received.
